Answer: Yes, "AB 168: Employers: Salary Information" (AB 168) applies to all employers, including charter public schools.

The purpose of the law is to protect the privacy of a job applicant's salary history and address wage inequality in California to help ensure equal pay for substantially similar work between employees of different gender, race, and ethnicity. Employers in violation of AB 168 are subject to monetary civil penalties under the Private Attorneys General Act.

It is recommended that charter public schools review their hiring processes and application materials, and inform individuals involved in the recruitment process of the new restrictions ASAP, as the law took effect on January 1, 2018.
