Member Update: CCSA v. OUSD (Prop. 39)

May 16, 2016 On March 8, 2016, CCSA filed a lawsuit against the Oakland Unified School District (OUSD)because of its failures year-after-year to equitably share public school space with all public school students in OUSD, including those served by charter public schools, as explicitly required by Proposition 39. Since the lawsuit was filed, CCSA and OUSD agreed to extend litigation deadlines so that CCSA could assess the legal compliance of OUSD's final space offers that were due on April 1. Under the agreement CCSA had the option to amend its complaint to add additional allegations if it determined that the final offers also failed to comply with Proposition 39. CCSA was disappointed to discover that OUSD's final offers also violate Prop. 39. As a result, CCSA amended its complaint on April 25 to add those further violations of law. OUSD has until May 25, 2016, to respond to the complaint.
