May 20, 2016 Question: Must a conversion charter school submit a Proposition 39 request to remain in a district facility?

Answer: If a charter school was established at an existing public school site (i.e., a conversion school), it must complete and submit an annual Proposition 39 Request for Facilities on or before November 1 of each year. In the absence of an express waiver from the annual application process, all charter schools, including conversion schools, must make an annual Proposition 39 request. We suggest the school and district's governing boards approve an agreement that waives the annual request obligation.
