April 30, 2016 Question: Does SB 359: California Mathematics Placement Act of 2015 apply to charter schools?

Answer: Yes. SB 359: California Mathematics Placement Act of 2015 requires all public schools, including charter schools, that serve 9th grade students to adopt a "fair, objective, and transparent" mathematics placement policy. The policy must include specific criteria, including a description of the objective academic measures that each charter school will consider in determining a student's mathematics placement, a provision for the annual examination of data to ensure that students are not held back based on race, ethnicity, gender or socioeconomic background, and a process for parents to question a student's placement. Charter school boards are required to adopt the policy at a regular meeting and post the approved policy on the charter school's website before the 2016-2017 school year begins.
