CCSA Answers: Does Education Code 49452.8 Apply to Charter Schools?

November 9, 2015 Question: Are charters exempt from the requirement to collect oral health assessment forms for incoming kindergarteners?

Answer: Education Code 49452.8 requires that a student attending a public school kindergarten "present proof of having received an oral health assessment by a licensed dentist, or other licensed or registered dental health professional operating within his or her scope of practice, that was performed no earlier than 12 months prior to the date of the initial enrollment of the pupil." This section is applicable to all public schools. Most authorizers require this practice to be included in a charter school's petition or renewal petition. We strongly recommend that charter schools work with their authorizers to determine how best to collect this information at their schools, and coordinate its reporting to county office of education through the authorizer.
