Cloud Data Software Agreements Pose a Breach of Privacy Risk to Schools

A recent article in Business Insurance magazine highlights a problem that has also come to the attention of CharterSAFE through our member schools. Many schools are now utilizing cloud-based software services for data storage, including student grades and personnel information.
Although the provider may offer assurances as to its ability to protect your HIPAA and FERPA (sensitive) data, the school is ultimately responsible for protecting the data it gathers.
How can a school protect itself and limit its potential liability? First, make sure that the vendor has a contractual obligation to respond to and mitigate damage caused by a privacy breach.
