California Supreme Court Issues Decision in Today's Fresh Start, Inc. v. LACOE

July 12, 2013 On July 11, 2013, the California Supreme Court issued a decision in Today's Fresh Start, Inc. v. Los Angeles County Office of Education, et. al. The Supreme Court upheld the Court of Appeal's decision holding that the statutory procedures for revocation of a charter are sufficient to satisfy constitutional due process legal requirements. The Supreme Court rejected Today's Fresh Start's bias and due process claims, some based on the lack of an adequate record. You can access the opinion here. Since the inception of this case, the State Board of Education adopted regulations that govern future charter school revocation proceedings, and, as a result, limiting the reach of this decision.
