Has Your District Responded to Your ADA projections?

December 1, 2011 Under Proposition 39, if a charter school submitted a request for facilities on or before the November 1st deadline, a school district is required to respond with any objections to the charter's Average Daily Attendance (ADA) projections in writing on or before December 1.

That deadline has already passed. Has your district responded to your ADA projections? Whether the answer is yes or no, please read the following information carefully, as it applies to your specific case, and make sure that you are aware of any holiday's your district may observe during this month.

If Yes:

CCSA has prepared template letters for members to use in responding to the district's December 1st ADA letters. Access all templates on the Proposition 39 Resources and Templates page. Under the Prop. 39 regulations, a charter school must respond to the district's concerns by either reaffirming or modifying its previous projections as necessary to respond to those concerns. If you fail to respond to the district by January 2, 2012, then the district's ADA projections provided in its December 1 letter are no longer subject to challenge. In an abundance of caution, charter schools may consider inquiring as to when their district closes for the holidays, and submit their response prior to any closure.

We recommend responding to the district's December 1 letter even if your district accepted your ADA projections. We suggest using your response as an opportunity to confirm that the district's facilities offer will be based on your ADA projections. We also provide a template for this correspondence.

If No:

Your ADA projections are no longer subject to challenge, and the district's facilities offer must be based on your ADA projections. CCSA recommends that you follow up with a letter confirming that the facilities offer will be based on your ADA projections. This template is also available on our website.
